Does anyone see a smoking gun in this video?

Only in America. This is sooooo petty. Am I glad I live in the city of St. Louis. Man, "Can't we all get along in the 21st century." Poor judgement on the part of store employee, management and the police. This town must really be out of touch with life. Sad how people can gag at flies and swallow camels. This is "petty racism." I am not one to go there, but this is ridiculous!

You're a fool not to see she was definitely at fault here!! You have to be blind not to see the so called smoking gun! When will the Black community hold their people responsible for their actions!! Maybe that's when I'll stop being so critical of the black community...

STacey said...

how was she at fault?? sounds like a petty argument i get disrespected and called out my name all the time by WHITE customers and do i call the police? NO we are supposed to smile in their face and wish them a nice day! shame on wal-mart and the police!!! Racism does exist, im white and i am absolutely appalled to say the least!

Chris said...

"Call them Out" What on earth are you talking about? Already it's been shown the police were lying when they said she refused to leave the store when the video shows her walking out. And where on in the tape did you see this assault on police officers or long drawn out effort to control her? And even if all this did happen...15 years??? Oh please... I see attempted murder and rape charges get 1 to 2 years...there's no denying this has a racial element

Anonymous said...

BEWARE MY PEOPLE, THE WORSE IS YET TO COME. THEIR TRUE COLORS ARE SHOWING 15 YRS? 15?. THE GUY AT ENRON STOLE 48 MILLION AND ONLY GOT 10. MAYBE SHE SHOULD HAVE GONE TO WALLSTREET AND WALKED OUT WITH A POLICE ESCORT.

Aaron said...

Regardless of the outcome. we can agree Heather Ellis is a true class act...between her pushing the other customers items, to her waving her middle finger at police, Heather Ellis is truly a positive role-model for all in America!

nbel said...

What in the world? It's only a line. No police has ever been called even when a person has cut line. People grow up. Life is too short. God help them, for they know not what they do. Amen!!

Anonymous said...

So Aaron, you think this woman deserves 15 years in PRISON for cutting in line and waving a finger, which by the way you can't tell it's the middle finger? Please, even hardened criminals doesn't get a sentence like that. She's not a treat to society. I've watched cop videos of people cursing and throwing things at cops just because they received a traffic ticket. It should be a crime to but someone in prison for some nonsense like this!

Anonymous said...

It's gonna be smoke in the city if she's convicted of some bull$h!t like this. Unbelievable!!!

Unknown said...

She had no right cutting the line and verbally and physically assaulting a police officer. She needed to wait her turn like the rest of the people. We as black people are always pulling the race card. If she's given a 15 year sentence it is because of the assault on a police office

Mark said...

even if the race factor is eliminated its still an absolutely ridiculous charge.People criticize that the race card is being used but i have not heard any other valid explanations i mean its absolutely ridiculous I don't care how crazy she got in that line, its not worth a felony and certainly not 15 years in jail. Nice to see our tax dollars are going to catch "criminals"...

Anonymous said...

I don't care what you people think you may know I live with racism everyday! At my job where I am the only black female, to going in a ramdom store and being followed, you are so quick to say it was her fault, all you saw was her arm, who's to say that the person in front of her didn't cut in front of her first! White people have been cutting in front of me for years but no one called the police!Wake up! It's racism running rampant!

Nicole J. Butler said...

Inconclusive. I can't tell what happened, and if the case hinges on the tape, I doubt that she will do any time. To jump to the conclusion that racism is in play is premature & as yet unwarranted.

This is totally "Petty" and made to be bigger than what it is....Police always use that "Resistance Arrest" for all people of color....this saying gives them the right to Shot you, Hit you and abuse you.....
"Resistance Arrest" is an excuse and alibi for POLICE BRUTALITY ....
According to the video I see nothing see done...and to be honest...this lady is too intelligent to be fighting with the police....it's a very PETTY situation .....and she should sue for DELFLIMATION of her character and slander of her name........

our laws and "white" lawyers are destroying our country. If you havent already noticed, Heather has hired a white lawyer to represent her. He gladly takes the case because to him, this case means being noticed and making money for following a bullshit discrimination law that he knows will be a sure win with NAACP support so he can fatten his pockets. Same thing with OJ Simpson, who got away with murdering a white woman because he knew he would be protected under discrimination laws with a crooked ass white lawyer looking after his needs at the same time. To the lady crying because she is the only black employee at her company and complains she is always discriminated against, affirmative action probably landed you that job and the company is forced to walk a tight rope with you and kiss your ass again because of the bullshit discrimination laws in this country while possibly a person of another race or gender, who should have gotten the job in the first place and more qualified is left out in the cold. You are fortunate enough to even have a job in this economy so stop whining! You are the last to go at work when downsizing occurs because of our lovely title 7 while whitey who works twice as hard as you do gets laid off or fired while you take the credit and the benefits. In my opinion this case is more along the lines of reverse discrimination and honestly, Americans are getting tired of people playing race cards even black Americans with character. Even I am brainwashed because I have to say people; not black people and sadly when I say black people, sometimes the context automatically makes me appear racist because it looks like I am profiling, yet a black person can call me anything they want and its all brushed off as a joke. I don’t care what neighborhood you are from or how you are raised, you have just as much opportunity to make something of yourself in this country than anywhere else in the world where people are having to merely survive instead of live comfortably. If you had to survive and placed in a desperate situation, all this would be nonsense. I have run into belligerent people of all races and creeds, and I have been forced to put up with scumbags everywhere I have been and I think Wal-Mart should stick up for themselves because I know that this kind of discrimination is not practiced by white people in present-day America no matter where it is due again to the lame ass laws associated with discrimination and the consequences involved for breaking them when a white person or a whole store chain can lose everything they have worked for in their life because of only one race-related false accusation coming from someone waiting for the right moment to point a finger and say "they discriminated against me because I am black." Rights can only be abused for so long until new laws are written or a civil war occurs. Unfortunately, this woman and others like her enjoy more freedoms, benefits, and perks than whitey in this country while they sit on their ass with idle time to stage a confrontation against another race to again reap the benefits of a corrupt race protection law and continue sitting on their ass until they rot and suck the government nest egg like a leech.

Total B S! Too much has been made of this incident. I feel that the authorities have gone too far to back down and not lose face. Period!

Nicole J. Butler said...

To the anonymous person who said:

"Even I am brainwashed because I have to say people; not black people and sadly when I say black people, sometimes the context automatically makes me appear racist because it looks like I am profiling,"

and then goes on to make racist statements,

Based on what you posted here, the reason you appear racist is because you are. To paint any group of people with the same broad brush is prejudicial and stereotyping. When you do that based on racial differences, it is racism.

There are 'baser elements' across all races and socio-economic strata of all societies, and there are also 'good people' found in all of the same places.

This tape doesn't show everything, so we don't really know what happened when all of the involved parties were out of the camera's range. To point fingers at this point is irresponsible and premature.

I firmly disagree with crying racism at every slight that involves more than one race, but to turn a blind eye would be naive. Your anger is misdirected, and you are sorely misinformed. In short, your post is a perfect example of racism being alive and well.

I wish you joy and enlightenment because you sound like you need a double-portion of both right now.

I was born and raised in Kennett Missouri, and i know the Ellis/Pulliam family very well. I have reviewed this case and watched the video footage very closely. I think that the lady behind Heather was not happy about the fact that she jumped line ahead of her, and became upset. I have determinded that the cashier noticted that the patron behind heather was not happy about this action by Heather ellis( keep in mind heather only had one or two items, and did not feel a need to place them on the conveyer belt). So, when it was Heather's turn to check out and pay for her items, the cashier took it upon herself to turn on the conveyer belt and move past Heather, as if she was not even standing there( that was not the job of the cashier-at all!). That is when Heather moved the merchandise back, so that she could be helped. The cashier did not re-act appropriatly in this matter which caused this problem. I agree that heather should not have cut line, but i also agree that if she were not have been black, she would be at home eating lunch right now! not in court!

im going to tell you something. Hiding under your intellectual wording is your true character and "you" are the one totally misinformed. "I" am speaking here what many a man and woman in this country quietly thinks which is the truth. When someone speaks these words, they are black-balled and deemed rebellious with our society especially a white male. Don't ever tell me about socio-cultural frameworks and try to explain to me in your half-ass language your interpretation. Damn it, time for retribution has long passed in this country for the black community and I will not be held accountable for what my ancestors did and I should not have to pay for what they did either because I had nothing to do with it, but this case is a perfect example of what happens to re-awaken the negative perceptions, and continual segregation of race. People are going to develop stereotypes no matter what because it is human nature. Our society encourages this through personal encounters, media channels and entertainment and there will be times someone could be singled out because of an individual or group of individuals prior experiences with another race. It exists and will never change. It is what it is. Maybe it is the black people that are separating themself from the rest, not the whites. Hmm lets see who the current president is who was voted in the office by majority whites, including me, so take your racist accusations elsewhere sister. Oh calling you "sister" offended you I bet!

IT'S A DIRTY SHAME HOW WHITE PEOPLE GET AWAY LITERALLY WITH MURDER, FRAUD ETC... AND GET A SLAP ON THE HAND. THEY THINK THE WORLD EVOLVES AROUND THEM AND IT'S THEIR WAY OR NO WAY. You mean English? I speak and write standard English. You seem to understand what I wrote, so what's the problem? That's called "communication." (btw., I said nothing of "social-cultural frameworks" - I wrote what I meant)

Okay, wait - is my language "half-ass" or "intellectual?" While you decide, I will say this:

Anyone who actually KNOWS me knows that I do my best to promote healing where wounds exist. Funny that you said I made racist accusations - point them out for me, please. I'd love to see them.

Comments like:

"People are going to develop stereotypes no matter what because it is human nature...It exists and will never change." are part of the problem rather than part of the solution. Gandhi said it best when he said "You must be the change you wish to see in the world."

No, your calling me "sister" didn't offend me. We are all sisters and brothers in a sense anyway, and if we really accepted that and acted accordingly, our differences would be appreciated rather than used as a tool to polarize us.

Nicole J. Butler said...

We really have no idea what happened when these people were not in the camera's lens, yet people are willing to jump to all kinds of conclusions and cry "racism." That's really sad.

Be proactive, not reactionary.

Nicole, you live in LA, What the heck do you know about life in a small southern town like Kennett Missouri?

Nicole J. Butler said...

I know that people are people, and I know racism is racism. I also know that there is not enough on this tape to be conclusive. I don't know what forthcoming testimonies will show, but I don't think jumping to conclusions helps anybody.

And, I haven't lived in L.A. all of my life. Even if I had, I've actually BEEN other places, I read, and I talk to people, so that wouldn't discredit my perspective.

Anonymous said...

Nicole, that's fair enough! Keep in mind that i know the parties involved! My perspective, point of view is much clearer than yours!

Anonymous said...

Here's the facts, (1) there is not enough on this tape to make the case alone, (2) 15 years for cutting in line is rediculous, there are law makers defrauding american's and they get off scout free,(3) racism is alive and well, I wish it wasn't but it is, (4) we need to get on our knees and pray because if this is what the world is coming to, we are all in a world of hurt.
So aspects of this case of the kids in court right now for rapping their order at McDonalds. These two cases say two things to me, (1) we have moved way too far from GOD, (2) we are all lacking with respect to the people that represent us.

People all need to do as the president ask and get involved.

LORD help us, we need you!!!

Nicole J. Butler said...

Good for you, I guess. I didn't know this was a contest, and I doubt that most of the people jumping on the bandwagon know either of these individuals.

I can remember back to when i was about four years old living in Kennett. I can recall hearing the Nigger word from white folk before i even knew what the word meant, and this was coming from other kids my age. I can still hear the sadness in my mother's voice, when she said that the house she was going to purchase was pulled off the market when they seen that the buyer was black( this was just five years ago). I know it appears to you that i may be jumping the gun regarding Heather's verdict in this case, but i know how white folks see blacks in this area!

Anonymous said...

failure to admit ones own faults, wanting to blame the "the white folk" this isn't a racial thing... she acted like an idiot threatened the police, threatened other customers and now wants to play the race card, causing disruption in the world when there are more important issues other than a criminal getting caught ... oh and if you want to call me names and cuss me out and call me this or that for saying the truth... go ahead my feelings won't be hurt cause i am intelligent and adult enough not to feel "dissed" have the urge to "pop a cap" in someone...hahahahaha

Anonymous said...

Wow, you are all so out of touch. This type of bad behavior happens every day, sometimes by white people, sometimes by black people. I can only say, when I am in line and someone does this it is extremely annoying. Anyone who cuts ahead, needs to be punished. It shows a blantant disregard to the rules of civil society. If it was African Americans on line and someone cut ahead, you would be just as insulted and angry. Her behavior was dispicable and reaction was outrageous. The country is done and the backlash will be severe. If you think you can behave with impudence, you will find out that it was a mistake. You are punished daily for your behavior. No jobs, no support, just poverty and suffering. Change your ways and raise yourselves up. MLK would not have been proud of you. We will help you then, right now, nothing.

Anonymous said...

Why couldn't she just wait her turn? That said I agree she shouldn't get in trouble for cutting in line but if she assaulted the police then there should be consequences. I can tell you if were to strike a police officer here in Tampa Fl I certainly would be arrested irrespective of my race or social status.

Anonymous said...

It appears to be a massive conspiracy centered on ms ellis. Perhaps al qaeda, the CIA and the KGB are in on it with the all the other customers, employees, and police. Yes the world is out to get her. ...... wonder if she wishes she had a time machine?

Anonymous said...

I hope that Heather Ellis learns from this experience. I would have agreed to the plea deal, which was fair in my opinion( since she did cut in line, which caused this mess from the jump start). I think that she took bad advice when she decided to take this very strong case( from the prosecution stance) to court.

In the video it certainly appears she was pushing another patrons goods out of the way to place her items on the counter. The employee working at the store confirms this and the fact she was loud and fould mouthed... so much they called police. The police... the men who protect and serve us daily... testified she resisted arrest. I don't see where she has a leg to stand on.... other than playing the race card. However, the race card got OJ off from murder, so it is a powerful card.

Anonymous said...

First of all,i think the tape has to be be carefully reviewed, but from what little i see theres no reason this lady should be held or arrested for anything,i can admit if im with someone at the store and i step out to go get something i get right back in line with the person im with i believe we all have done that come on america life is to short and the economy is to messed up to be wasting tax dollars on the case, just let it go get a life.when all this was going on and all those police was available im sure somebody,s mother, grandmother, sister,or daughter was being raped, beaten or mudered focus on the real issues here and this world will be a better place, and thats all i have to say.

My name is Eric i placed that comment above about to many police being on the scene and not where they real probably needed to be,because i know at the time somebody really needed them, its not a racial issue for me just my personal opinion and we all are entitled to that, but if we could just learn to put aside our differences and hatred this world we live in would be a much better place to live.

People go to jail everyday for acting stupid. You don't wanna face stupid ammounts of time for nonsense? Don't participate in nonsense. There are people of all color and background in jail for crimes they did not commit. If the state can chuck up a buncha time for the things this woman actually did, f**k her, that's the law that keeps people from running around acting like she did.

"Facing" never equates to what you are sentenced with. A shoplifter "faces" up to 5 years, that doesn't mean they get any more than probation. Telling the time she's "facing" is nothing more than media propoganda. They gotta have a story, right?

As a white person and not ever knowing what a black person has ever been through as far as racism, I can tell you this. No one deserves to be treated like the person that was cut off. People have been cut off before but the way she swiped stuff off. NOPE ... No one, race, gender, whatever deserves to treat another like that. Does she deserve 15 years, heck no. Does her mother need to slap her for being disrespectful. HECK YEAH ... If my 26 year old son did that to someone, I'd make sure he NEVER EVER DID IT AGAIN !!! Just down right ugly as a human being.

good grief. if ANYONE jumped in front of me in a line and shoved my stuff out of the way in order to make room for HER stuff there would be hell to pay. this video is silent but it speaks words.

put yourself in the shoes of the person ellis butted in front of and watch your stuff being repeatedly shoved out of the way over and over.

HELL YEAH i'd say something - i wouldn't name call but i'd ask her exactly who the hell she thought she was! this isn't grade school where "butting in line" is "cool" - in fact, it wasn't even cool in grade school. all it ever did was piss off the people you butted in front of. sort of like the way ellis did here at walmart.

get a freakin' grip, people. if anyone had done this to you, you would NOT have just stood there and let a belligerent arrogant customer step in front of you. you would have NOT been polite and courteous to someone who was disregarding everyone else but herself.

this was plain offensive - how dare this woman shove stuff already in progress on the conveyor belt!

what a double standard to say "oh it was only butting in line..." as if that was okay.

your stuff being pushed back repeatedly on the conveyor belt? i think none of you would have tolerated this behavior.

The media was the one who ran with the headlines "15 years for cutting in line." She was never going to receive anywhere near 15 years and she wasn't on trial for cutting in line. She was on trial for assulting police officers. She should have been charged and convicted of resisting arrest at the very least. People are missing the fact that her actions that night were terrible and she should never be allowed to teach children again....do you really want her teaching your children?

Kionna,

all while you are trying to prove your point here that I am racist, thats fine but you are probably one of the many minorities calling the so-called majority derogatory names and internally, I myself have resentment when reading cases like this and it just gets old. Just because you and I are sticking up for our race and how differences are manifested in this country maybe both of us can be considered racist. The difference is, these feelings are held internally in today's world and were openly expressed years ago unfortunately by my ancestors, but I refuse to justify feeling sorrow for people of all races, not just black, because I am moving on and I am not going to be held responsible for what my ancestors did because I had nothing to do with it and every person regardless of race has ample opportunity to succeed. One day soon Hispanics are going to be the majority in this country and these issues hopefully will dissolve with more time because they will become more influential in this country. Unfortunately, these feelings cause segregation. A world with multi-race prosperity will never occur. Read the scripture and it will tell you that all over the world, races have been divided and differences have always existed. It is what is and thats all I am going to add today.

To all who care or concerned. I totally agree that this is petty, racist, and also an outrage by Walmart, and those so called Officers. Definition: Men in uniform who has mental Issues and cannot control themselves (black or white)they become cops because this is the only way they can control people or vent their Inner anger on anyone they choose (speaking from experience and proven Them Guilty), it's time that this is put to an end!! I feel as if the cashier, and Walmart misjudged and only wanted to prove more of their Republican beliefs. Fact: They told their Employees to ONLY vote Republican at a store meeting. How Racist is that? Do you CARL, and So-Call-Anonymous Nov. 22 at 10:45am, not get it? I am saying to you Carl, did you know you can move from "THE BACK OF THE BUS"?...But if it hurts being Black tell God see what he can do for you. By the way, you stated she assaulted those police officers. Did you see that, because it seems the majority of us cant see that and it looks to me that they just needed another lie of an alibi that's not on tape. If pulling the race card when definitely needed is necessary then why not? Cutting someone in line(if true, not seen), Cursing (not heard), pushing Items backwards is all I see. There has been many times when I've been in a line and the cashier is too dumb to stop the belt and just let the Items of the person behind me keep going when my Items is ahead or in my hand. So you tell me, what is the argument, dumb cashier. Yes, exactly!! And even if they say she did all this, 15 years, for what? Being Black, this does not Include you. Now for So-Called-Anonymous who can't even post his true name or face but yet have so much to say. Last time I checked O.J. Simpson was found Innocent by "COURT OF LAW", your peers!! I'm just going to objectively say, according to the appearence of your Intelligence that you have no job or have never been accused or abused by anyone in uniform, or simply a Black took your job and was just darn Smarter than you. Your long speech also speaks highly that you've never been responsible for any lawful acts of Kindness ever in your life. It's sad but I wish you well. I'd like to thank you for thinking so highly of the "NAACP", we are grateful. To Anonymous Nov. 20, 5:25pm, who said...Stop acting like Niggers, I am going to think positive that you said that using the dictionary meaning because their is all colors and kinds of Ignorant "N"'s. To Anonymous Nov. 21, 12:13pm who said...just give her 40 Acres and a mule. The comment I would like to leave for you I don't think it's legel but your definitely one of the Nigger's the dictionary is speaking of!! As for the true Victim here, Heather Ellis, "FIGHT FOR YOUR RIGHTS", because we as human Blacks are still trying to overcome the power of prejudice in this country. I saw where you/she did nothing wrong according to the video and if words were used unconstructively I'm sure they were necessary. There is no case for a 15 year sentence or otherwise. God Bless you!! To those of you who see differently, get some eye glasses and realize Walmart was wrong with their actions and the cops who participated are liars!! My thanks to Nicole J. Butler who stated: Inconclusive, If the case hinges on the tape, I doubt that she will do any time. To jump to the conclusion that racism is in play premature and as yet unwarranted. Suggestions for everyone "WATCH OTHELLO". Blessings to you all!

I find the reaction to this case funny. Why does everyone play the race card without knowing the facts. The fact is Ms. Ellis is 100% at fault. She started the entire incedent. Did others over react..yes but fault is completly hers. And the overreaction of 15 years is funny. It was actually up to 15 years for assault on a policemen and resisting arrest. 15 years was the max and never would had happened. Cutting in line had nothing to do with it. With no record on her file she would have gotten a slap on the wrist and sent home with community service. Everyone jumping on it caused it to blow up. Is there racism..of course your an idoit if you dont hink there is in the world. In this case..no one knows except for those involved. Ms. Ellis is not a class act she is at fault and offered no appology for acting like a spoiled child unwilling to accept respocilbilty for her actions. It is these cases that over shadow the real cases where racism is at work and while a number of people should be ashamed of their actions, Ms. Ellis is should be in the fore front of them all them

And by the way, a number of people who posted are pure and simply racists bot black and white. You really need to take a long look at yourselves cause right now you are only wasting oxygen the rest of us could use. And OJ Simpson, really, come on. Only those truly blinded by race think he is innocent. He carved up the mother of his children out of spite and anyone who defends him is insane. No sane pesron thinks he is innocent. People need to look at themselves this season cause you need a lot of help. And to the person who commented about "WATCH OTHELLO" maybe the problem is peole watch to much crap. If you really want to learn something and seem smart, try READING Othello, its quite good

It is amazing how people want to pull the race card here when they know NOTHING about what happened. You see little snippets of video that do NOT show the entire series of events, nor do they have any sound to hear what was said. From what I am experiencing as a white male born and raised in NY, and transplanted in the south-Racism from my perspective is a two-edged sword. I run into black people EVERY DAY who act like they hate me for NO apparent reason. I can hold a door open for somebody coming out of a store and get some snide remark and a dirty look. I come from a place where we all got along. I never started feeling ANY bad will towards ANYBODY of color until I experienced it OVER and OVER again myself. In fact, I had written many anti-racism papers in college. Now I just expect bad attitudes, so I am not hurt/disappointed 9/10 times when I encounter somebody of color in my life when they shit on my good will. Nice job on setting us back 40 years... I used to be on your side.

@ the guy who posted above & said: "I used to be on your side."

That's really sad. What you're saying now is you've become what you despise. Your attitude is up to you - manage it wisely.

@ Nicole J. Butler-

Perhaps you are a robot, but I am not. I am a human. Like most humans with reasonably normal sociological traits, I have become conditioned by my experiences. Would you continue to swim in the ocean if 9/10 times that you did a shark bit one of your toes off? I sure wouldn't. You can call it "managing behavior" all you want. In fact, I do manage my behavior because I just move along when I should confront people who are hateful. People should be held accountable for their negative contributions to the human race. But if I did, people like the band wagon jumpers here would just say I am the racist whitey and it would simply perpetuate this nonsense even more. So what does one do? Pretend that everything is cool and ignore the fact that I know from absolute personal experience that anti-white racism is THRIVING among blacks? As in...many have become what they despised?

Hello again, "Anonymous." Surprised to receive a notification of your response in my inbox after all this time!

All I have to say is what I have said: We, as human beings (no matter the race, since race is a social construct anyway), have the ability to choose our course of action, rather than relying on our baser instincts to guide us. To once again paraphrase Gandhi, we have to change in order to change our world. If someone does something to you and it makes you angry, either confront the anger with the intent to correct, or find a way to move on FOR YOUR SAKE. If you allow others to "make you" bitter and resentful, they control you, and you gave them the reins.

Now, addressing the issue of race here for one last time (since this is no longer about the video, but about race relations): there are 'sharks' who bite peoples' toes off (to use your analogy) in every race & walk of life. But there are even MORE schooling fish who do no harm. I prefer to focus on those. Sometimes I get bitten by a shark (and bites cause damage, no matter WHAT color the shark may be), and I have to deal with the repercussions of that for awhile, but I refuse to let the actions of 'sharks' handle the reins of my thoughts, my emotions, or my life. I just keep it moving.

Onward & upward! I wish you the best with your life and truly hope that your perspective shifts. I am done posting here, but should you (or anyone) wish to engage in discussions with me, I'm on Twitter.

You will definitely find that i'm not a robot.
